Terms and Conditions for Shilpeasy

Welcome to Shilpeasy ("Shilpeasy," "we," "our," or "us"). By accessing or using our website and services (the "Platform"), you agree to comply with and be bound by these Terms and Conditions (the "Terms"). Please read them carefully.

1. Acceptance of Terms

By using the Platform, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.

2. About Our Service

Shilpeasy currently offers beginner acoustic guitar packages (each a "Package") that include: (a) an acoustic guitar, (b) necessary accessories, and (c) a scratch card that enrolls the purchaser in our online course upon redemption (the "Scratch Card"). After enrolling, users can view course materials on our website (the "Course").

3. Eligibility

You must be at least 13 years old to use the Platform. If you are under the age of majority in your jurisdiction, you represent that you have parental/guardian permission to use the Platform.

4. Accounts & Security

You may need an account to purchase Packages and access the Course.
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
Notify us immediately if you suspect unauthorized use of your account.

5. Orders, Pricing & Payment

All orders are subject to availability and our acceptance.
Prices, discounts, and offers may change without prior notice; the price at checkout applies to your order.
Taxes, shipping, and handling (if applicable) will be shown at checkout.
By submitting payment information, you represent that you are authorized to use the chosen payment method.

6. Shipping & Delivery

We will provide an estimated delivery date; however, delays may occur due to factors beyond our control.
Risk of loss passes to you upon delivery to the address you provide. Please ensure accurate shipping details.
Upon delivery, inspect your Package promptly, and ensure you received each item as mentioned in the package details, including the scratch card and carefully (see Section 8 for defects policy).

7. Scratch Card & Course Enrollment

Each Package includes one Scratch Card with a unique code. Keep the Scratch Card secure.
Redeem the code on our website to enroll in the Course. Codes are single-use and non-transferable once redeemed.
Do not share your code publicly. Lost or shared codes may result in denial of access and are not replaced except at our sole discretion.

8. Defects, Refunds & Replacements (48-Hour Window)

We only consider a refund or replacement if a defect is reported within 48 hours of delivery.

If your guitar or included accessories arrive damaged or defective, you must contact us within 48 hours of the recorded delivery time.
Include your order number, a description of the issue, and clear photo/video evidence of the defect and packaging.
Upon verification, we will (at our option) offer a replacement, repair, or refund. You may be asked to return the defective item in original packaging.
Exclusions: damage caused by misuse, neglect, improper storage, unauthorised repairs/modifications, normal wear and tear, or cosmetic blemishes that do not affect functionality.
Reports submitted after 48 hours from delivery are not eligible for refund or replacement under this policy.

9. Course Access & License

Upon valid enrollment, you receive a limited, non-exclusive, non-transferable, revocable license to access and view the Course materials for your personal, non-commercial use.
You may not copy, record, redistribute, publish, resell, or create derivative works from the Course materials without our prior written consent.
We may update, modify, or remove Course content from time to time to improve quality and accuracy.

10. Intellectual Property

All content on the Platform, including text, images, videos, logos, and Course materials, is owned by Shilpeasy or its licensors and protected by applicable intellectual property laws. Unauthorized use is prohibited.

11. Prohibited Uses

Interfering with or attempting to circumvent security features of the Platform.
Sharing, selling, or sublicensing access to the Course or Scratch Card codes.
Uploading malware or engaging in fraudulent, deceptive, or unlawful activities.

12. Disclaimers

Except as expressly stated, the Platform, Packages, and Course are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow limitations on implied warranties; in such cases, these limitations may not apply to you.

13. Limitation of Liability

To the maximum extent permitted by law, Shilpeasy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Platform, Packages, or Course, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid for the applicable Package.

14. Indemnification

You agree to indemnify, defend, and hold harmless Shilpeasy and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Platform or Course.

15. Changes to the Terms

We may update these Terms from time to time. When we do, we will revise the Effective Date above. Continued use of the Platform after changes become effective constitutes your acceptance of the updated Terms.

16. Suspension & Termination

We may suspend or terminate your access to the Platform or Course at our discretion if we believe you have violated these Terms or applicable law. Upon termination, your license to access Course materials will cease.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of Bangladesh, without regard to conflict of laws principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in Dhaka.
